Supreme Court has paused the High Court’s order on the Ayushman Bharat Scheme in Delhi

Supreme Court has temporarily halted a Delhi High Court decision directing the Delhi government to sign a Memorandum of Understanding to carry out the Ayushman Bharat Health Infrastructure Mission (PM-ABHIM) scheme. Following the hearing of a petition by the Delhi government contesting the High Court ruling, a panel of Justices BR Gavai and AG Masih issued notices to the Centre, AIIMS, and the Municipal Corporation.

Last month, the High Court ordered the central and state governments to execute an agreement by January 5 to ensure that the central program is implemented in the national capital.

The AAP government in Delhi has been fighting the national initiative, claiming that the city receives “superior benefits” from state government schemes.

The situation threatens to exacerbate political tensions between the BJP and the AAP as the city prepares for vital elections to determine its next government.

Delhi government, argued before the Supreme Court today

Senior counsel AM Singhvi, representing the Delhi government, argued before the Supreme Court today that by forcing them to sign an MoU with the Centre, the High Court had redefined the central government’s capabilities in the health sector.

The High Court ordered the Delhi government to fully implement the initiative to ensure that people do not go without funding and facilities. The bench led by Justice Pratibha M. Singh stated that not adopting the ABHIM Scheme in Delhi would be unjustified because it has already been implemented in 33 states and union territories.

Despite the fact that the Model Code of Conduct was in effect for the February 5 elections, the court allowed the MoU to be signed.

In opposition to the PM-ABHIM initiative in the High Court, the Delhi government stated that the city already has the Delhi Arogya Kosh (DAK) scheme, which is a “far more robust program”. It contended that, although the central system only affects 12-15 percent of the city’s population, the DAK scheme has a broader scope.
