Sanjiv Khanna : Justice Sanjiv Khanna Take Oath As India’s 51st Chief Justice

Sanjiv Khanna : Today Justice Sanjiv Khanna was sworn in as India’s 51st Chief Justice, after Justice DY Chandrachud recommended his name as his successor.

President Droupadi Murmu conducted the oath of authority at Rashtrapati Bhavan.

Prime Minister Narendra Modi and outgoing Chief Justice of India DY Chandrachud both attended the occasion.

On October 24, the Centre officially confirmed Justice Khanna’s being appointed, which was recommended by Chief Justice Chandrachud. On November 8, Justice Chandrachud’s last working day, the justices, attorneys, and staff of the Supreme Court and the High Courts bid him farewell.

Who is Justice SANJIV Khanna?

Justice Sanjiv Khanna has participated in several historic Supreme Court decisions, including defending the sanctity of EVMs, removing the electoral bonds scheme, upholding the repeal of Article 370, and granting temporary release to former Delhi Chief Minister Arvind Kejriwal.

Justice Khanna comes from a famous Delhi family; he is the son of former Delhi High Court judge Justice Dev Raj Khanna and the nephew of notable former top court judge HR Khanna.

Prior to his appointment as a Supreme Court judge on January 18, 2019, Justice Sanjiv Khanna was a third-generation lawyer. He is motivated by a desire to eliminate backlog and speed up justice delivery.

Justice HR Khanna, Justice Khanna’s uncle, made headlines in 1976 by resigning after giving an opposing view in the infamous ADM Jabalpur case during the time of emergency.

The majority ruling of a Constitution court supporting the suspension of fundamental rights during the Emergency was viewed as a “black spot” on the judiciary.

Justice HR Khanna deemed the decision illegal and contrary to the rule of law, and he faced the price when the then-central government chose Justice MH Beg as the next CJI.

Justice HR Khanna was a part of the landmark 1973 Kesavananda Bharati decision, which established the basic structure theory.

Justice Khanna was born on May 14, 1960, and studied law at Delhi University’s Campus Law Centre.

He was an executive director of the National Legal Service Administration (NALSA) and was admitted as a lawyer by the Delhi Bar Council in 1983. He started practicing law at the District Courts at the TisHazari complex before moving on to the Delhi High Court.

He worked as senior standing counsel for the Income Tax Department for many years. In 2004, Justice Khanna was named Standing Counsel (Civil) for Delhi’s National Capital Territory.
